Welcome to Virtuweb (“Company”, “we”, “our”, “us”). These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with our website (the “Site”) and the services we provide (the “Services”). Please read these Terms carefully before using our Site or Services. By accessing or using the Site or Services, you agree to be bound by these Terms.

Through this website, you are able to link to other websites which are not under the control of Virtuweb. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.

Every effort is made to keep the website up and running smoothly. However, Virtuweb takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.

General Terms

Acceptance of Terms: By accessing our Site or engaging our Services, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our Site or Services.

Changes to Terms: We reserve the right to modify these Terms at any time. Any changes will be posted on this page, and it is your responsibility to review these Terms periodically. Your continued use of the Site or Services after any changes constitutes your acceptance of the new Terms.

Privacy Policy: Our Privacy Policy, available on our Site, explains how we collect, use, and protect your personal information. By using our Site or Services, you agree to the terms of our Privacy Policy.

Intellectual Property

Ownership: Upon full payment, the Client will own the rights to the final deliverables of the Project. We retain the right to use any work created for promotional purposes unless otherwise agreed upon.

Use of Third-Party Materials: Any third-party materials used in the Project will be subject to the applicable third-party licenses. The Client agrees to adhere to these licenses.

VirtuCare Terms

Monthly Website Maintenance: To keep your site safe and secure we will log into your WordPress website once a month and update all your plugins. We will also update WordPress when necessary. If plugins are not updated they can leave security flaws in your website. We will do basic testing of your website to check for any errors that may have been caused by the plugin updates. Should any issues arise we will fix them.

Helpdesk Priority: You will be able to email any request, problem or question to [email protected] and receive priority support. This means we’ll respond to your email by the next working day and aim to resolve the problem as soon as we can, rather than booking it for the next available date.

Hosting, Domain Renewal + SSL Certificates: Unless agreed upon differently, We will manage and pay for the renewal of your annual hosting, ensuring it’s the correct size for the content and number of visitors to your website. We will manage and pay for the renewal of your primary domain. We will also manage and renew your SSL Certificate, ensuring it’s the correct level of security required for your website.

Website Backups: Every night we’ll take a backup of your website so it’s saved to restore in case it gets hacked or taken down. Your website will have 30 days’ worth of backups available.

Analytics Tracking: Plausible Analytics will be installed on your website so we can analyse and monitor traffic to your site. This helps us optimise the site for web presence and traffic. Full access is given to you and anyone else in your business who you approve. It provides you with a basic analysis of where visitors have come from and what they do on the website. This is not an SEO service.

Termination of your Website Care Package: Should wish to terminate your Website Care with us, you have the right to give us a month’s written notice. We will then give you the option of either 1) Virtuweb helping you migrate to alternative hosting (£100 one-off payment) and then you pay ongoing hosting fees to our hosting partner, or 2) Virtuweb providing your website details to your own developer so you can custom migrate to your new hosting (Free of charge but we strongly recommend to employ a professional web developer to assist you with migrating your website).

Domain Names

To ensure the proper maintenance of your website, we may request access to your domain name settings. Please be assured that we will not modify any account or billing information associated with your domain. Any changes we make will be limited to the DNS settings necessary for the functioning of your website. We will not alter any other DNS settings unless explicitly agreed upon with you in writing.

As part of our VirtuCare plans, we offer a service that includes transferring the ownership of your domain to us and covering the cost of domain renewal for easier management. While the domain will be registered in our name for administrative purposes, you will retain full ownership rights.

If, at any time, you wish to regain ownership of your domain, we will promptly facilitate the transfer process. Please note that once ownership is transferred back to you, you will be responsible for managing the domain renewal and DNS settings.

If you prefer to retain full control over your domain, we can recommend alternative solutions to ensure optimal performance and cost efficiency, such as utilising Cloudflare for CDN services and improved domain management.

Migrating to alternative hosting

Process: If you notify us in writing that you no longer wish for Virtuweb to host and maintain your website, and you wish to migrate your website to your own hosting provider with the assistance of a qualified developer, we will facilitate access to your website files on our server.

Cost: If the migration is taking place with your own developer, there is no charge for this migration service. However, we strongly recommend engaging a competent and experienced developer to ensure the safe and efficient migration of your website. Please note that Virtuweb cannot recommend specific developers, and you assume full responsibility for your choice of developer. Should you wish for us to facilitate the migration to a separate hosting, we charge £100 for this service.

Hosting, Domains, and SSL Certificates: Once the migration is complete, you will be notified by email. At that point, you will assume full responsibility for the ongoing hosting of your website with your chosen provider, as well as the renewal and payment of all associated domain names and SSL certificates.

Website Maintenance: After migration, you will be solely responsible for maintaining the security and functionality of your website. This includes, but is not limited to, updating plugins, updating the WordPress core, performing browser compatibility tests, and managing all website content.

Paid Plugins: Following migration, you will also be responsible for the payment, renewal, and ongoing maintenance of any paid plugins used on your website.

Liability: Once migration is complete and you have been notified via email, Virtuweb will no longer be responsible for the uptime, security, or content of your website.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the UK, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the UK.
